Heard Ms. Afshan Shafaut, learned counsel for the petitioners and Sri Jhamman Ram, learned AGA appearing for the State- respondents.
The order sheet of the case indicates that on 17.02.2021 an objection was raised by the learned AGA to the effect that there are no specific particulars in the petition giving details with regard to the alleged detention of the petitioner nos. 2 and 3 and accordingly a petition for a writ of habeas corpus would not be entertainable. On 15.03.2021 learned counsel for the petitioners sought an adjournment to file a supplementary affidavit placing on record the necessary particulars.
The order sheet further indicates that thereafter adjournments have been sought by the counsel for the petitioners on a number of occasions.
Today when the case is taken up, despite repeated queries learned counsel for the petitioners has not been able to demonstrate from the pleadings any specific particulars which may indicate that the petitioner nos. 2 and 3 are under any kind of illegal detention.
Having regard to the aforesaid this Court is not inclined to exercise its extra ordinary jurisdiction in the matter.
The petition seeking a writ of habeas corpus is accordingly dismissed.
