Heard learned counsel for the petitioner and the learned A.G.A. This writ petition has been filed praying for the following reliefs:
"(i) Issue an appropriate writ, order or direction quashing the First Information Report by respondent no.3 on 20.07.2021, lodged by the respondent no.3 in case crime no. 0221 of 2021 Under Sections 3(1) Gangster Act, & Anti-Social Activities (Prevention) Act 1986, relating to Police Station- Dudhara, District- Sant Kabir Nagar. (vide annexed as Annexure no. 1 to this petition).
(ii) Issue an appropriate writ, order or direction commanding the respondents concerned not to take any coercive measures against the petitioners in pursuance of the impugned First Information Report dated 20.07.2021."
After the arguments were heard at some length, learned counsel for the petitioner states that the petitioner wants to withdraw the writ petition with liberty to apply for bail.
Learned A.G.A. has no objection to the aforesaid request of the petitioner.
In view of the aforesaid, the writ petition is disposed off with liberty to the petitioner to apply for bail as permissible under law and in accordance with law.
It is made clear that we have not expressed any opinion on merits of the case of the petitioner.
