JUDGMENT / ORDER

The petitioner has approached this Court challenging Ext.P5 order issued by the District Magistrate, Kozhikode refusing the renewal of armed licence. The petitioner’s grievance is that this order was passed without application of mind. Ext.P7 was refused on account of the objection raised by the District Police Chief on security point of view. It seems that District Police Chief has raised a general objection in issuing licence. 2. The armed licenced licence has to be issued or renewed based on the individual requirement and objections. Therefore, this has to be reviewed from the individual angle rather than in a general angle.
3. Learned Government pleader points out that the petitioner has an alternate remedy before the Land Revenue Commissioner under Section 18 of the Arms Act.

4. Considering the factual situation, I am of the view that the petitioner can raise his objection before appellate authority. The appellate authority shall consider the application of the petitioner on its merits while considering the appeal. Therefore the petitioner shall approach Land Revenue Commissioner within a period of two weeks from the date of receipt of a copy of this judgment. On receipt of this appeal, the Land Revenue Commissioner shall pass appropriate orders on appeal within a further period one month after affording an opportunity of hearing to the petitioner.
Land Revenue Commissioner, Public Office building, Museum Junction, Thiruvananthapuram is suo motu impleaded as additional 3rd respondent.
