Order: (per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) This writ petition is filed questioning the police action with regard to the complaint lodged in Crime No.235 of 2014.
It appears from the F.I.R. that it was lodged with regard to a missing girl. The police started investigation and it appears from the result of the investigation that the missing girl was with the father.
Under the circumstances, we are of the view that in a case of this nature, the police will take steps in accordance with law and as to whether any arrest is required to be made for this purpose or not. We are not making any comment on this issue. However, we make it clear that the learned Family Court will proceed with the O.P., which is pending before it in accordance with law and we have not decided anything on that issue.
The interim order granted earlier shall stand modified to the extent indicated above.
The writ petition is accordingly disposed of.
Consequently, the miscellaneous applications, if any pending, shall also stand closed. No order as to costs.
