ORDER:
This Criminal Revision Case is filed by the petitioners aggrieved by the order dated 10.10.2014 in Crl.M.P.No.1749 of 2014 in S.T.C.No.122 of 2011 passed by the Judicial First Class Magistrate at Jammalamadugu, YSR Kadapa District.
Heard the learned counsel for the petitioners and learned Public Prosecutor for respondent-State.
Having regard to the facts and circumstances of the case, there is suspension of the execution of the non-bailable warrant pending against the petitioners for fifteen days after receipt of the order by giving liberty to the petitioners to file fresh petition under Section 70 (2) Cr.P.C. with personal appearance of the accused before the learned magistrate and in such event the learned Magistrate shall recall the warrant and obtain bonds if not already executed by the accused persons so to execute as contemplated by sections 88 and 89 Cr.P.C. for their future appearance. Petitioners also given liberty if necessary to file fresh application under Section 205 Cr.P.C. to represent through Special Vakalat Holder Advocate and in such event the learned Magistrate shall consider to permit by necessary orders and to appear as and when personal appearance required, needless to say if the Special Vakalat holder is prepared to answer in Section 313 Cr.P.C. examination, accused personnel presence need not be required.
Accordingly, the Criminal Revision Case is disposed before admission.
