The petitioner has filed the Writ Petition praying to issue a WRIT OF MANDAMUS directing the respondents to disburse the petitioner's maturity deposit amount (bearing Deposit Receipt No.45195, 45196 and 45197) to the tune of Rs.1,50,000/-(Rupees One Lakh and Fifty Thousand only) together with interest.
2. According to the petitioner, the Petitioner had deposited a sum of Rs.1,50,000/- in the year 2013 and subsequently renewed in the year 2015 for a further period of two years. The date of maturity was 21.02.2017. Subsequent to maturity, the petitioner approached the fourth respondent bank and requested to disburse the amount, but the fourth respondent has not disbursed the said amount, so far. The petitioner also made representation before the respondents 1 to 4 on 26.04.2017, but the respondent without disbursing the said amount, had dragged on to settle the amount. Hence, the petitioner has filed this Writ Petition for the above said prayer.
3. The learned counsel for the petitioner would submit that being a senior citizen, at the age of 87 years, has lost his wife recently. He further submitted that his legs are severely damaged due to sugar complaint and as per Doctor's advice he has to undergo surgery. Hence, the petitioner is struggling to lead his life. But, the respondents, without considering the said facts, are not disbursing his deposit. With no other alternative, the petitioner has approached this Court.
4. In view of the above said facts, as the prayer sought for by the petitioner is having limited scope, without going into the merits of the case, this court is inclined to direct the fourth respondent to consider the petitioner's representation dated 26.04.2017 on merits and in accordance with law and pass orders, preferably within a period of six weeks from the date of receipt of a copy of this Order.
