ORDER:
This writ petition is filed for the following substantive relief:
“For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon’ble Court may be pleased to issue an appropriate Writ, order or direction, more particularly one in the nature of Writ of mandamus declaring the action of the respondents 3 and 4 in not renewing the license of the petitioner’s saw mill M/s.Alla Bakash Saw Mill on the renewal application dated 24.11.2014 made by the petitioner is as illegal, arbitrary, unjust and violation of Articles 14, 21 of the Constitution of India and also contrary to the A.P. Saw Mills (Regulations) Rules, 1969 and consequently direct the respondents 3 and 4 to renew the license of the petitioner’s saw mill M/s.Alla Bakash Saw Mill pursuant to the renewal application dated 24.11.2014 made by the petitioner.”
At the hearing, Sri S.Lakshminarayana Reddy, learned counsel for the petitioner requested for permission of the Court to withdraw the Writ Petition in view of the fact that his client has made an application for renewal well within the prescribed time and that the same is pending before the licensing authority, with liberty to avail appropriate remedy in the event, the respondents act in any manner, which may infringe the right of the petitioner to run the Saw Mill.
The request of the learned counsel is accepted and the writ petition is dismissed as withdrawn with liberty to the petitioner in terms of the prayer made.
As a sequel to dismissal of main petition as withdrawn, WPMP.No.50283 of 2014 filed by the petitioner for interim relief is disposed of as infructuous.
