This writ petition is filed for a Mandamus declaring the impugned proceedings Rc.No.667/2013-D, dated 29-03-2014 issued by the 3rd respondent as illegal and improper and for a consequential direction to the 3rd respondent to permit the petitioner to distribute kerosene oil to the card holders of F.P. Shop No.9 of Bapatla Town, Guntur District.

The grievance of the petitioner is that one Patakonda Pandu Ranga Rao, kerosene retailer for fair price shop Nos.9 and 14 of Baptla Town died on 16-10-2013 due to ill-health and the 4th respondent, son of Patakonda Panduranga Rao, the neighbour kerosene retailer was kept in charge for Shop Nos.9 and 14 of Bapatla Town. The petitioner made a representation on 27-01- 2014 for allotment of kerosene for the card holders of F.P. Shop No.9 of Kerosene retailer, late Patakonda Panduranga Rao and the 3rd respondent vide proceedings dated 04-02-2014 directed the petitioner to distribute kerosene oil to the card holders of F.P. Shop No.9 only in Bapatla Town and the 4th respondent is directed to distribute kerosene oil to the card holders of F.P. Shop No.14 only. It is stated that the 3rd respondent vide proceedings dated 29-03-2014 issued orders arranging the 4th respondent temporarily kerosene retailer for F.P. Shop No.9 in his place. Challenging the said proceedings, the petitioner preferred an appeal on 04-04-2014 before the 2nd respondent, but no orders are passed on the appeal. Aggrieved by the said action, the present writ petition is filed.
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Civil Supplies.
In view of the fact that the petitioner has already filed an appeal before the 2nd respondent on 04-04-2014 against the orders of the 3rd respondent, it is for the 2nd respondent to pass appropriate orders on the appeal filed by the petitioner. Therefore, the 2nd respondent may consider and disposal of the appeal filed by the petitioner, after giving a reasonable opportunity of hearing to the petitioner as well as the 4th respondent herein and pass appropriate orders in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of the order.
With the above direction, the writ petition is disposed of. No costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
