HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.39721 of 2014 ORDER:
The petitioner claims to be the owner of lands to an extent of Ac. 2.20 cents in Survey No.55/2, Ac. 0.17 cents in Survey No.55/3, Ac. 0.45 cents in Survey No.77/P, Ac. 0.30 cents in Survey No.76/P and Ac. 0.55 cents in Survey No.80/P (totally admeasuring Ac. 3.67 cents), situated at Mangalam Village Accounts, Mangalam Post, Mittagandhipuram Village, Tirupathi Urban Mandal, Chittoor District. The petitioner alleges that when he approached the Sub-Registrar, Renigunta, Chittoor District (4th respondent) for the purpose of alienation of the property, the 4th respondent insisted for obtaining No Objection Certificate and is refusing to receive and process the Deeds of Conveyance. However, no material is filed in support of the said assertion.

Having regard to the same, the Writ Petition is disposed of, without expressing any opinion on merits, granting liberty to the petitioner to present the Deeds of Conveyance concerning the lands above mentioned and as and when such Deeds of Conveyances are presented, the Sub-Registrar, Renigunta, Chittoor District (4th respondent) shall receive and process the same in accordance with the Registration Act, 1908, and the Indian Stamp Act, 1899. If the Sub-Registrar is not inclined to agree for registration of the documents, he shall pass orders assigning reasons and communicate the same to the petitioner. Such exercise should be completed within a period of three (3) weeks from the date of receipt of the documents from the petitioner. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
