This Criminal Petition is filed to quash proceedings in STC.No. 15 of 2013 on the file of Special Judicial Magistrate of Second Class at Utnoor, Adilabad district, for alleged offences under section 290 and 506 of IPC.
2. Heard Advocate for Petitioner.
3. Advocate for petitioner submitted that charge sheet allegations do not attract the ingredients of section 503 of IPC which defines criminal intimidation and the offence under section 290 of IPC.
4. As seen from the material papers filed along with this Criminal Petition, Police after investigation filed charge sheet against petitioner, who is an Assistant Sub-Inspector of Police.
5. On a perusal of the material, I am of the view that the objections now raised by the petitioner are the defences available and he can urge all these grounds before trial court and trial court shall consider the same without being influenced by the dismissal of this Criminal Petition.
6. Accordingly, this Criminal Petition is dismissed at the admission stage.
7. As a sequel, miscellaneous petition if any, pending in this Criminal Petition shall stand closed.
