THE HON'BLE SRI JUSTICE S. RAVI KUMAR CRIMINAL PETITION No.8528 of 2012 ORDER:
This petition is filed to quash First Information in Crime No.732/2012 of Kushaiguda Police Station for alleged offences under Sections 420, 468, 471, 506 & 120-B IPC.
2. Heard both sides.
3. Advocate for petitioner submitted that the allegations in the complaint ex-facie not convincing and the defacto- complainant is now contending that the sale deed of the year 1979 is a forged document, by giving a complaint in the year 2012 and his assertions in the complaint are ex-facie incorrect and improbable. On the other hand, learned counsel for second respondent submitted that the signature of this complainant is also forged for obtaining the sale deed and that complainant came to now about the same only in the year 2012 and these aspects are matter of evidence and at this stage, correctness of these allegations cannot be decided.
4. Considering the contentions and rival contentions of both parities and the material papers filed along with the quash petition, I feel, instead of going into merits, directing the police to proceed with investigation and complete it, as expeditiously as possible, without arresting the petitioner, till completion of investigation, this petition can be disposed of.
5. For these reasons, petition is disposed of directing the police to expedite investigation and complete it, as early as possible, and in the meantime not to arrest the petitioner-A2 till completion of investigation.
6. As a sequel, miscellaneous petitions, if any, pending in this Criminal Petition shall stand disposed of.
