Respondent Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a writ of Mandamus, directing the respondent to pass final order on enquiry conducted on 05.12.2016 based on the notice dated 23.11.2016 in proceeding No.3259/ A3/ 2015 in pursuant to the complaint of the petitioner with in the stipulated time fixed by this Court.
For Petitioner : Mr.C.Prabakaran For Respondent : Mr.E.Balamurugan Addl. Govt. Pleader O R D E R Mr.E.Balamurugan, learned Additional Government Pleader, takes notice for the respondent. By consent, the main writ petition itself is taken up for disposal at the admission stage itself.
2. The petitioner has filed the above writ petition to issue a Writ of Mandamus, directing the respondent to pass final order on the enquiry conducted on 05.12.2016 based on the notice dated 23.11.2016 pursuant to his complaint, within a time frame.
3. The learned counsel appearing for the petitioner submitted that the respondent had already conducted enquiry, however, he has not passed the final order yet.
4. Mr.E.Balamurugan learned Additional Government Pleader appearing for the respondent submitted that the respondent may be directed to pass final orders, in accordance with law, within a time frame.
5. In view of the submissions made by the learned counsel on either side, without expressing any opinion with regard to the merits of the case, I direct the respondent to pass final order on the enquiry conducted on 05.12.2016, based on the notice dated 23.11.2016, in accordance with law, after giving an opportunity of hearing to all the interested parties, within a period of four weeks from the date of receipt of a copy of this order.
With these observations, the writ petition is disposed of. No costs.
