THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP THIS DAY, THE COURT MADE THE FOLLOWING;
ORDER Learned counsel for the parties submit ad idem that the issue involved in this writ petition is squarely covered by the order passed by this Court in W.P.No.50152/14, disposed on 23rd March 2016.
2. The said submission of the learned counsel for the parties is placed on record.
3. The subject matter of this writ petition being identical to the issue involved in W.P.No.50152/2014, this writ petition stands disposed of in similar terms.
4. It is made clear that the respondents shall take action in accordance with law holding an appropriate inquiry to determine that there is indeed encroachment with reference to the title deeds of the petitioner and actual measurements of the property and it is only after an appropriate order being passed, the respondents shall take any further action in respect of the alleged encroachment, otherwise, they shall not interfere with the petitioner’s property except under due process of law.
