JUDGMENT / ORDER

T.Ravi, S/o. Venkataiah .. Petitioner (Accused in Cr.No.78/2011 of Kavali Rural P.S., SPSR Nellore Dist) AND The State of A.P., rep .by its Public Prosecutor, High Court of A.P., Hyderabad.
Respondent/defacto-Complainant Petition under Sections 437 and 439 of Cr. P.C. praying that in the circumstances stated in the grounds filed herein, the High Court may be pleased to enlarge the petitioner on bail in Crime No. 78 of 2011, dt. 19-05-2011 on the file of Kavali Rural P.S., SPSR Nellore District.
The Petition coming on for hearing upon perusing the petition and grounds filed herein and upon hearing the arguments of Sri L.Dayaker Reddy, Advocate for the Petitioner and of the Public Prosecutor for the Respondent, the Court made the following ORDER:
“ Heard both sides.
This criminal petition is filed under Sections 437 and 439 of Cr.P.C. seeking bail for the petitioner-accused in Crime No.78 of 2011 of Kavali Rural Police Station, SPSR Nellore District for the offence punishable under Section 8(c) read with 20(b) of Narcotic Drugs and Psychotropic Substances Act, 1985.
The petitioner is said to have possessed 220 kgs., of ganja. He is said to be the driver of the lorry in which contraband is found. The petitioner is in judicial custody since 17.12.2013.
It is represented that the investigation in this case has been completed and charge sheet has been filed on 20.02.2014 and the same has been taken on file as P.R.C. The petitioner is said to be the local resident of Vangapadu village and there are no previous antecedents against the petitioner.
Considering the above circumstances, I deem it appropriate to enlarge the petitioner on bail.
Accordingly, this Criminal Petition is allowed. The petitioner shall be enlarged on bail on his executing a personal bond for Rs.10,000/- (Rupees Ten Thousand Only) with two sureties in a like sum each to the satisfaction of the learned Additional Judicial Magistrate of First Class, Kavali.”
