ORDER:
The petitioners pleaded that their father had been in possession of Ac.0.80 cents out of Ac.2.40 cents in Survey No.45 of Gollapalli Village, Chandragiri Mandal. That in recognition of the said fact, he was granted lease of the land for 1387 Fasli and that since then, his father had been in possession of the property and after his death in the year 2011, the petitioners have been in possession of the same. The petitioners made a representation on 22.04.2012 to respondent No.4 for grant of assignment or lease to enable them to carry on agriculture. As the said representation is not considered, the petitioners have filed this writ petition.
At the hearing, the learned Assistant Government Pleader for Revenue (Assignments), on instructions, submitted that eksal lease was granted to the petitioners’ father in the year 1976 and that thereafter, the same was not extended. She further submitted that the land, which was classified as Cart Track Poramboke, is being used by the villagers as cart track and therefore, the petitioners are not in possession of the same.
In my opinion, if respondent No.4 has reasons for not accepting the request of the petitioners, he is expected to issue an appropriate endorsement disclosing such reasons for rejecting their request. Failure of respondent No.4 to follow this procedure has needlessly driven the petitioners to file this writ petition. Therefore, respondent No.4 is directed to consider the petitioners’ representation and communicate his decision in writing with reasons in support thereof to them within one month from the date of receipt of a copy of this order.
With the above directions, the Writ Petition is disposed of.
As a sequel to disposal of the writ petition, W.P.M.P.No.1280 of 2014 filed by the petitioner for interim relief is disposed of as infructuous.
