ORDER:
This writ petition is filed for a mandamus to set aside proceedings in Rc.No.4179/14-L, dated 18.09.2014, of respondent No.3, whereby he has suspended the petitioner’s fair price shop authorisation.
On 14.10.2014, this Court on prima facie examination of the impugned order felt that the same appeared to have been passed by respondent No.3 for extraneous reasons and accordingly, the said respondent was called upon to show cause as to why disciplinary action shall not be ordered to be initiated against him for suspending the petitioner’s fair price shop authorisation on trivial grounds and allegedly for extraneous reasons. On 05.11.2014, respondent No.3 was personally present and the learned Government Pleader for Civil Supplies stated that respondent No.3 has realised his mistake in issuing the impugned proceedings and that he is advised to take corrective steps.
Today, at the hearing, the learned Government Pleader for Civil Supplies has placed before the Court a copy of proceedings in Rc.No.4179 /14-L, dated 08.11.2014, whereunder respondent No.3 has withdrawn the impugned proceedings and restored the petitioner’s fair price shop authorisation. At the hearing, respondent No.3 has assured that he will not repeat this conduct by passing orders similar in nature to the impugned order.
Having regard to the corrective steps taken by respondent No.3 and the assurance given by him as noted above, the writ petition is disposed of as infructuous.
As a sequel to disposal of the writ petition, W.P.M.P.No.38175 of 2014 shall stand disposed of as infructuous.
