Heard learned counsel for the parties.
This writ petition is filed questioning the punishment of postponement of annual increments for a period of one year which shall have its effect on future increments and treating the period of suspension as ‘not on duty’. The petitioner states that against the said punishment, he had filed an appeal which is pending before the second respondent since 2009. However, the said appeal is not taken up and decided. A copy of appeal petition filed by the petitioner in 2009 is annexed to the writ petition which shows grounds of appeal.
Since the appeal is pending from 2009 and has not been considered so far, it would be just and appropriate to direct the second respondent to consider the said appeal after notice to the petitioner and after hearing him, pass appropriate orders in accordance with law within two months from the date of receipt of a copy of this order.
The writ petition is accordingly disposed of. Miscellaneous applications, if any, shall stand closed. No costs.
