This Writ Petition is filed for a Mandamus to set aside the proceeding in Rc.(M).No.857/2014, dated 25-10-2014, issued by respondent No.3, whereby he has suspended the petitioner’s authorization in respect of fair price shop No.53 of Santhekudlur Village, Adoni Mandal, pending enquiry.
This Court by interim order, dated 07-11- 2014, has suspended the impugned order. As no instructions have been reported by respondent No.3 on earlier two hearing dates i.e., 24-11-2014 and 01-12-2014, this Court has directed the personal appearance of respondent No.3.
Today, at the hearing, Mr.B.Ch.Obulesu, Revenue Divisional Officer, has submitted that his predecessor has suspended the petitioner’s authorization and that after the interim order was passed by this Court, he has realized that the petitioner could not commence distribution of the essential commodities as he was not supplied with the Aadhar Card linked Key Register, and that as the petitioner was not at fault, vide Rc.M.No.857/2014, dated 27-11-2014, he has revoked the impugned order of suspension, dated 25-10-2014.
In view of the remedial steps taken by respondent No.3 by withdrawing the impugned order of suspension, dated 25.10.2014, and restoring the petitioner’s authorization, the Writ Petition is disposed of as infructuous.
As a sequel, interim order, dated 07-11-2014, is vacated and WPMP.No.41623 of 2014, filed by the petitioner for interim relief, is disposed of.
