(By Smt.A.Lalitha-Advocate) …..Petitioner ...Respondent This Criminal Petition is filed under Section 482 of Cr.P.C., to set aside the order dated 18.06.2015 passed by the MMTC-II Court, Bangalore City passed in C.Misc.No.232/2012 confirmed by the Court of LXV Additional City Civil and Sessions Judge, Bengaluru (CCH No.66) by rejecting in Crl.A.No.835/2015 filed by the petitioner by order dated 17.03.2017 rejecting the same.
This petition coming on for ‘orders’ this day, the Court made the following:
O R D E R The learned counsel for the petitioner files a memo requesting this Court to convert this Criminal Petition into Criminal Revision Petition.
2. Considering the factual aspects narrated in the memo, memo is considered.
3. Registry is hereby directed to convert this Criminal Petition into a Criminal Revision Petition and post the case before the Court having roster.
4. Learned counsel for respondent submits that the petitioner has deposited some amount before trial Court in-lieu-of the maintenance and same may be ordered for release for which petitioner’s counsel has no objection. Hence, respondent is entitled to receive the money before the trial Court which is already deposited by the Petitioner.
5. IA-2/2017 does not survive for consideration as the matter is disposed of on merits.
For statistical purpose, this Criminal Petition is ordered to be disposed off.
