2. The grievance of the petitioner is that respondent Nos.4 and 5, who are stated to be adjacent farmers, have allegedly dug a new bore well without permission under WALTA and thereby affecting the petitioner. It is stated that petitioner made a representation before the Collector and under proceedings of the Collector, dated 24.12.2013, respondent No.3 was directed to take necessary action. Alleging inaction on the part of respondent No.3, the present writ petition is filed.
3. Learned Government Pleader, on instructions, states that respondent No.3 has already acted on the said grievance of the petitioner and notices have already been issued and the proceedings under Section 15 of WALTA are pending with respondent No.3.
In view of the above, therefore, the writ petition is disposed of directing respondent No.3 to consider the representation after notice and hearing all the affected parties as well as the petitioner and then take a final decision in the matter, in accordance with law, expeditiously preferably within two months from the date of receipt of a copy of this order. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
