Public Prosecutor ORDER This Criminal Original Petition has been filed seeking a direction to the second respondent to take immediate steps to impound the passport standing in the name of the first respondent, who is concerned with Crime No.1/2011 on the file of the second respondent.

The grievance of the petitioner is that as against the first respondent herein, she has lodged a complaint before the second respondent and the same was registered as Crime No.1 of 2011 for the offences punishable under Sections 498(A), 406 and 506(i) IPC, which is pending. While so, she came to understand that the first respondent, in order to escape from the clutches of law, has planned to leave from India. Hence, she has filed the present petition for the above stated relief.
3. Today, when the matter was taken up for consideration, learned Additional Public Prosecutor, on instructions, submitted that in Crime No.1 of 2011, after completion of investigation, charge sheet was filed before the learned Judicial Magistrate, Uthiramerur and the same was also taken on file as CC No.105 of 2011.
4. Considering the facts and circumstances of the case, this Court is not inclined to entertain this petition. However, considering the fact that the case is pending from 2011 and as agreed by both the parties, this Court directs the learned Judicial Magistrate, Uthiramerur to dispose of the case in CC No.105 of 2011 pending on his file, on merits and in accordance with law, as expeditiously as possible, preferably, within a period of four months from the date of receipt of a copy of this order. Both the parties are directed to co-operate with the trial court for early disposal.
5. Accordingly, this Criminal Original Petition is disposed of.
