SYED KHALEEL PASHA, ADVOCTE FOR C/R) THESE WRIT PETITIONS ARE FILED UNDER ARTICLE 227 OF THE CONSTITUTION OF INDIA PRAYING TO QUASH THE ORDER PASSED BY THE IV ADDITIONAL CITY CIVIL JUDGE, IN BANGALORE IN O.S.NO.26528/2018 DATED 25TH JANUARY 2019 AT ANNEXURE-G AND ETC., THESE PETITIONS COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER Petitioners being the defendants in a declaration suit in O.S. No.26528/2018 have invoked the writ jurisdiction of this Court for assailing the order dated 25.01.2019, a copy whereof is at Annexure-G, whereby the injunctive relief was granted to the respondent herein. After service of notice, the sole respondent being plaintiff in the suit having entered Caveat through her counsel, resists the writ petitions.
2. The counsel for the respondent is absent.
However the respondent personally submitted that the matter is compromised; the said respondent is identified by the second petitioner Smt. T.G.Padmavathamma; she has exhibited the original Adhaar Card and has placed a copy thereof on record.
The parties having amicably resolved the lis, have filed a compromise petition reporting settlement and seeking disposal of these writ petitions in terms thereof.
This Court having perused the contents of the compromise petition and having interacted with the parties is of the considered opinion that the settlement is in the best interest of all the parties and that there is no any impediment for recording the said compromise and dispose off the main matter in terms thereof. Parties shall sign the order sheet.
Ordered accordingly. No costs.
