JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) THURSDAY, THE SIXTH DAY OF NOVEMBER TWO THOUSAND AND FOURTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR BETWEEN T.Arun Kumar AND WRIT PETITION No. 33143 of 2014 ... PETITIONER The State of Telangana, Rep. by its Principal Secretary (Department of Revenue), A.P. Secretariat Building, Hyderabad and others.
...RESPONDENTS The Court made the following:
ORDER:
Heard.
2. Petitioner, who claims to be son of one of the victims, who were rescued in the raid conducted under Immoral traffic (Prevention) Act on 01.01.2014 at H.No.4-12/62, Sri Sai Durga Nagar, Bodduppal, seeks to question the lodging of the said victim in the rescue home. The present writ petition is, therefore, filed to seek her release. The allegations in the affidavit, particularly, the remand case dairy filed by the police before the Jurisdictional Magistrate relating to F.I.R. booked bearing No.728/2014 itself, prima facie, shows that A1 to A5 committed the offence and the victims appears to have been sent to rescue home.
3. Though the petitioner does not give any details, as per orders of the learned Magistrate the victims might have been lodged in the rescue home. In any case, however, since the learned Magistrate is seized of the matter, petitioner can always move the learned Magistrate for appropriate orders/directions, which he seeks with regard to the lady, which according to him is the victim in the crime. This court, therefore, cannot entertain the writ petition directly in the absence of any information with regard to the orders of the learned Magistrate under which the alleged victims are sent to the rescue home.
Hence, the writ petition is dismissed with the liberty as aforesaid. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
