When the matter came up for hearing on 17.09.2011, there was no representation for either side. Again on 11.01.2017, there was no representation for the appellant. Hence, on 11.01.2017, the matter was directed to be posted today under the caption 'for dismissal'. Even today, there was no representation. This Court has noted that the first respondent is reported dead and notice to the second respondent is yet to be served. It appears that no one is interested in prosecuting this appeal and no steps have been taken to implead the legal representatives of the deceased first respondent. Hence, this appeal is dismissed for non-prosecution. No costs.
