Heard Sri Gajendra Singh, learned counsel for the petitioner and learned Standing Counsel for the respondents-State.
Sri Gajendra Singh, learned counsel for the petitioner submits that the mark-sheets of the students of Madarsa Alia Jafarya, Naugawan Sadat, District-Amroha, who have appeared in the examination of Alim in Persian and Kamil-II for academic session 2017-18, have not been issued. The academic future of the students is in jeopardy on account of such inaction of the said respondents authorities. The petitioner being the principal of the institution has also made a representation in this regard to the respondent No.2. However, no action has been taken.
Learned Standing Counsel submits that the matter is factual in nature and has to be verified by the competent authority.
No useful purpose will be served by keeping the petition pending.
The matter is remitted to the respondent No.2. A mandamus is issued to the respondent No.2 to consider and decide the representation of the petitioner in regard to the issuance of the mark-sheets to students of Madarsa Alia Jafarya, Naugawan Sadat, District-Amroha who have appeared in the examination of Alim in Persian and Kamil-II for the academic session 2017-
18. The representation shall be decided within a period of one month from the date of receipt of a certified copy of this order along with the fresh copy of the representation.
In case the students have been denied their mark-sheets as is alleged in the representation, the respondent No.2 shall ensure that the mark-sheets are released forthwith upon confirmation of such facts.
With the aforesaid direction, the writ petition is finally disposed of.
