The petitioner approached the learned Upa-Lokayukta with a prayer, which is as follows:
“It is, therefore, prayed to direct the Tahsildar, Qutubullapur Mandal to demarcate the plots 1028 square yards as per sale deeds four in number by cancelling the pattas issued to weaker sections and Police Station, Dundigal and be pleased to pass such order, orders as this Hon’ble authority may deem fit and proper in the circumstances of the case.”
From a reading of the aforesaid prayer, it appears to us that the grievance of the petitioner is absolutely a civil dispute. Therefore, the learned Upa-Lokayukta did not consider the complaint of the petitioner appropriately and rightly rejected the same. However, we feel that the learned Upa-Lokayukta should not have gone into the merit of the matter.
Under the aforesaid circumstances, we dispose of this Writ Petition recording that the findings of the learned Upa-Lokayukta will not be binding factor if the petitioner approaches the appropriate forum with his grievance.
Miscellaneous Petitions, if any, pending shall stand closed.
No order as to costs.
