Order:
The vexed plaintiff in OS.No.574 of 2007 has filed this Civil Revision Petition, under Article 227 of the Constitution of India, for a direction to the I Additional District and Sessions Judge, Ranga Reddy District, to dispose of the suit.
This Court, considering the plea of the petitioner that written statement in the suit was filed on 27-11-2007, expressed its surprise nay anguish that issues were framed more than five years after filing of the suit. It has, accordingly, called for the proceeding sheet in the suit. After going through the proceeding sheet, I could concede that more than half of the entries are almost illegible and difficult to decipher. However, to the extent I could follow, I find no justification whatsoever in keeping the suit pending for such a long time. The suit was coming up for issues from 29-11-2010 and it took more than two years’ time and 11 adjournments for the lower Court to frame the issues. This is a sad reflection on the mode of functioning of the lower Court. Even after framing of issues, no reasonable dispatch has been shown by the lower Court to complete the trial and dispose of the suit. If this trend is continued, I am afraid the litigants will lose faith in the legal system. Before that, danger takes place, it is necessary for the Institution to take corrective steps. The lower Court is directed to dispose of the suit peremptorily within four months from the date of receipt of this order, failing which this Court will take a serious view.
Subject to the above direction, the Civil Revision Petition is disposed of.
As a sequel, CRPMP.No.386 of 2014, filed by the petitioner for interim relief, is disposed of as infructuous.
