Heard learned counsel for the applicant.
Learned counsel for the applicant is alleging non-compliance of order of writ Court dated 21.04.2014 passed in Writ Petition No. 2301 (S/S) of 2014 (Syed Sajid Husain Vs. State of U.P. and others), whereby the writ Court while appreciating the fact that inquiry officer submitted inquiry report on 03.03.2014, directed the disciplinary authority to pass final orders on the issue in question, in accordance with law, within a period of one month from the date of receipt of a certified copy of order.
Submission of learned counsel for the applicant is that copy of the order of writ Court along with letter dated 26.04.2014 was served personally in the office of opposite party. It is also submitted that in pursuance of the order of writ Court, the District Basic Education Officer, Gonda vide letter dated 03.05.2014 directed the applicant to appear before him on 15.04.2014 for presenting his case and accordingly, applicant appeared before him on 15.04.2014. Grievance of the applicant is that the time prescribed by the writ Court has already expired long back, but no final order has been passed by the District Basic Education Officer, Gonda in pursuance of the order of writ Court. Therefore, the applicant is constrained to approach this Court by means of present Contempt Petition for initiating proceedings against the opposite party under the provisions of Contempt of Court Act for willful disobedience of order dated 21.04.2014 of the writ Court.
On due consideration, prima facie, a case of willful disobedience of the order of writ Court is made out.
Let notice be issued to opposite party to appear before this Court on 14.08.2014 to show cause as to why proceedings be not initiated against him under the provisions of Contempt of Court Act for willful disobedience of order of the writ Court dated 21.04.2014 passed in Writ Petition No. 2301 (S/S) of 2014 (Syed Sajid Husain Vs. State of U.P. and others).
It is provided that if order of the writ Court is complied with and compliance report is filed, the opposite party need not appear before this Court on the date fixed.
