ORDER:
This Civil Revision Petition arises out of order dated 9-6-2014 in I.A.No.881 of 2013 in O.S.No.1170 of 2009 on the file of the learned II Additional Junior Civil Judge, Ranga Reddy District, whereby she has dismissed the application filed by the petitioners for receiving a document as secondary evidence.
At the hearing, Sri Sharad Sanghi, learned Counsel for the petitioners, did not dispute that the order dated 16-6-2001 in File No.B/1643/98 of the Mandal Revenue Officer, Rajendranagar Mandal, which is sought to be brought on record as secondary evidence, is neither the original order nor its certified copy and that the same is only a purported copy of a certified copy. In view of the same, the said document does not fall under Section 63 of the Indian Evidence Act, 1872 and consequently Section 65 of the said Act is also not attracted.
The learned Counsel requested for leaving liberty to the petitioners either for obtaining a certified copy or summoning the document from the Mandal Revenue Office, Rajendranagar Mandal.
The said request of the learned Counsel is accepted and the Civil Revision Petition is accordingly dismissed, with liberty in terms of the prayer made.
As a sequel to the dismissal of the Civil Revision Petition, CRPMP No.4850 of 2014 filed for interim relief is disposed of as infructuous.
