JUDGMENT / ORDER

Heard learned counsel for the revisionist learned counsel for the opposite party No. 2 and learned AGA for the State and perused the record.
This revision has been filed with a prayer to set aside the order dated 4.3.2021 passed by Addl. Principal Judge, Family Court no. 2, Firozabad in Case No. 924 of 2017 (Smt. Nazia Rahman and another Vs. Syed Mehroz Ali), under section 125 Cr.P.C., P.S. Dakshin, District Firozabad.
It has been argued by learned counsel for the revisionist that the revisionist is very poor person and he is doing the daily wages worker of a factory and earning very meager amount, but the learned court did not considered this aspect of the matter and passed the impugned order against the revisionist and without calculating the income of the revision directed that the revisionist to pay Rs. 2,500+500= Rs. 3,000/- per month as maintenance to O.P. No. 2 an 3.
Considering the submissions made by learned counsel for the revisionist that the revisionist is ready to deposit the half of the amount i.e. Rs. 72,000/- in four equal installments within four months from today as directed by the court below from the date of application to the O.P. No. 2 and 3.
Notice on behalf of opposite party no. 1 has been accepted by learned A.G.A.
Issue notice to opposite party no.2 and 3 returnable at an early date.
List after four months in the additional cause list on top ten cases.
Till the next date of listing, further proceedings of the aforesaid case shall remain stayed against the revisionist.
