ORDER:
This writ petition is filed assailing the appointment of respondent No.4 as mutawalli of Anjuman-e-Khadimul Muslimeen situated at Kachiguda, Hyderabad.
At the hearing, Mr. M. Mehdi Hussain, learned counsel for the petitioner, while conceding that his client has the remedy of approaching the Wakf Tribunal, under Section 83(2) of the Wakf Act, 1995, however, submitted that the Presiding Officer of the Wakf Tribunal is not posted, that an in-charge officer is holding charge of the Tribunal and that he has not been considering the urgent applications.
In view of the availability of the effective alternative remedy, I am not inclined to entertain this writ petition for adjudication on merits.
The petitioner is at liberty to approach the Wakf Tribunal for redressal of his grievance. However, in view of the grievance expressed by the learned counsel for the petitioner, the officer-in- charge of the Tribunal is directed to entertain the application that may be filed by the petitioner and pass appropriate order thereon expeditiously.
Subject to the above observation and direction and without expressing any opinion on the legality or otherwise of the impugned order, the writ petition is disposed of.
As a sequel to disposal of the writ petition, W.P.M.P.No.1105 of 2014 shall stand disposed of as infructuous.
