Heard learned counsel for the parties.
The petitioner complains that the respondent No.3 is interfering and trying to settle civil disputes between them and the respondents 4 to 7 with regard to the land admeasuring 0-72 cents in Sy.No. 597-3 situated at Nellore Bit-1 and threatening the petitioners to vacate the premises at the instance of the respondents 4 to 7. Hence the writ petition.
Learned Government Pleader for Home, on instructions, submits that the 5th petitioner filed a complaint on 21.6.2014 alleging fraud and collusion with respect to registration of a document purported to have been executed by her by impersonating her etc and on the basis of the said complaint, a case in Cr.No. 267 of 2014 was registered under Sections 467, 468, 471, 506 r/w. 34 IPC, on 21.6.2014 and the investigation is pending with the third respondent. He further states that except registration of the said case, the police have not interfered with any civil dispute nor threatened the petitioners as alleged.
Learned counsel for the petitioners, however, states that on the face of it, the said complaint, purportedly filed by the 5th petitioner against the petitioners 6 and 7 and others, is improbable and created by the third respondent by obtaining the signature of the 5th petitioner on a blank paper. The learned counsel for the petitioners also states that the petitioners have already filed an appropriate complaint before the Deputy Superintendent of Police, Nellore on 22.9.2014 against the false registration of the said complaint and the DSP is yet to pass appropriate orders. However, this is not subject matter of this writ petition and hence cannot be gone into.
In so far as the allegation of interference by the third respondent in civil disputes, the learned Government Pleader for Home, on instructions, submits that except registration of the case, the police have not interfered in the civil disputes and never pressurized the petitioners to vacate the premises.
In view of the aforesaid submission, no orders are necessary to be passed in this writ petition. However, the third respondent shall have liberty to investigate the case in Cr.No. 267 of 2014 in accordance with law. So far as civil rights of the petitioners and the respondents 4 to 7 are concerned, they shall be resolved by the parties concerned by approaching the civil court, if not already approached.
Accordingly the writ petition is disposed of. Miscellaneous applications, if any, shall stand closed. No order as to costs.
