The Court made the following :
THE HON'BLE SRI JUSTICE S. RAVI KUMAR CRIMINAL PETITION No.1884 of 2014 ORDER:
This petition is filed to quash the proceedings in D.V.C.No.292/2012 on the file of XIV Special Magistrate Court, Somajiguda, Hyderabad.
2. Heard Advocate for petitioners.
3. None appeared on behalf of 1st respondent in spite of service of notice.
4. Advocate for petitioners submitted that all the family members are implicated in the D.V.C., first petitioner is father-in-law, second petitioner is mother-in-law, third & fourth petitioners are brothers-in-law and petitioners-5, 6 & 7 are sisters-in-law of first respondent and that they are nothing to do with the reliefs claimed. It is further submitted that all the allegations are against husband only and therefore, the proceedings against them have to be quashed.
5. I have perused the complaint. There are specific allegations against the petitioners also and the protection officer under the Act after enquiry included the names of the petitioners along with husband as respondents, therefore, at this stage correctness of the allegations in the complaint and the report of the protection officer cannot be decided. Taking the facts of the case and the relationship between the parties, I feel by directing the Court below to expedite the enquiry and dispose of D.V.C., within stipulated time by dispensing with the presence of the petitioners for each and every adjournment, this petition can be disposed of.
6. Accordingly, the learned XIV Special Magistrate, Somajiguda is directed to dispose of D.V.C.No.292/2012, as expeditiously as possible, preferably within three months from the date of receipt of this order and the presence of petitioners for each and every adjournment is dispensed with. However, they shall appear if the trial Court feels that their physical presence is necessary for any specific purpose.
7. With this observation, Criminal Petition is disposed of.
8. As a sequel, miscellaneous petitions, if any, pending in this Criminal Petition, shall stand disposed of.
