Syed Khaja Hussain and others … Petitioners and The District Collector, Cuddapah and others … Respondents THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.16739 OF 2004 O R D E R The petitioners are aggrieved by the alleged inaction on the part of the respondent authorities in granting assignment pattas to them in respect of the land admeasuring Ac.5.00 cents in Sy.No.1014/3 of Bodeddulapalli village, C.K. Dinne Mandal, Cuddapah District. They seek a consequential direction to the authorities to grant them assignment pattas in respect of the said land.
2. Despite the passage of nearly ten years, the respondent authorities have not chosen to file a counter-affidavit in the matter.
3. It is relevant to note that by order dated 17-09-2004, this Court directed the respondent authorities not to grant assignment pattas in favour of any third party in respect of the subject land. According to the petitioners, they are in possession of the subject land. Further, it appears that the first petitioner also addressed written representation dated 28-08-2004 to the District Collector, Cuddapah, praying for assignment of the subject land.
4. Given the aforestated circumstances, the writ petition is disposed of directing the District Collector, Cuddapah, to consider the representation dated 28-08-2004 made by the first petitioner and pass appropriate reasoned orders thereon in accordance with law. The said order shall be duly communicated to the petitioners. Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
