This application has been filed for the modification of the order dated 08.03.2019 wherein the Sub Divisional Officer was directed to decide the application filed by the petitioner on 30.04.2016.
The grievance of the petitioner is that because of various instructions which the Sub Divisional Officer had produced before this Court, the Sub Divisional Officer was not going beyond the instructions. He, therefore, submits that a direction be issued that the inquiry may be done independent of the instruction sent by the Sub Division Officer.
It is, therefore, directed that the Sub Divisional Officer Mariyahun, District Jaunpur shall decide the representation of the petitioner independently without being influenced by the instruction which he had sent to the Court. Needless to say that the representation shall be decided within one month of the presentation of the certified copy of this order.
Accordingly, modification application is allowed.
