Heard Sri Kunwar Bhadur Dixit, learned counsel for the petitioner, learned Standing counsel for the State- respondent and Sri Sudhir Bharti, learned counsel for the Gaon Sabha.
The present writ petition under Article 226 of the Constitution has been filed for the following reliefs:-
"(i) Issue a writ, order or direction in the nature of mandamus, directing and commanding the respondent no.2, District Magistrate, Deoria for taking necessary appropriate action not to disposses by the Village Pradhan to petitioner from his land in question during pending case before the court of Deputy Director of Consolidation, Deoria in Revision No. 233/434 of 1992."
It reflects from the record that Revision Nos. 233/434 of 1992 is pending before respondent no.3 Deputy Director of Consolidation Deoria and the petitioner has remedy to approach the said authority for staying his dispossession over the land in question. The application/ representation filed before the District Magistrate, Deoria during the pendency of the case before the Deputy Director of Consolidation at all not maintainable.
After the order was passed, learned counsel for the petitioner states that he does not want to press the present writ petition and the same may be dismissed as withdrawn.
Prayer is accepted.
The writ petition is dismissed as withdrawn.
