ORDER:
This writ petition is filed for the following substantive relief:
“…to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in entering the land of the petitioner in Sy.No.740/3, adm. Ac.0-08 guntas out of Ac.3-10 guntas of agricultural land situated at Ponnaram village of Mandamarri, Adilabad District without issuing any notice to petitioner and without following the rules of Land Acquisition Act and without fixing awarding and paying compensation towards land of the petitioner as illegal, arbitrary and in violation of principles of natural justice and consequently issue a direction to the respondents to pay total compensation of Rs.79,00,000/- (Rupees seventy nine lakhs only) forthwith and to pass such other or further orders as this Hon’ble Court may deem fit and proper in the circumstances of the case.”
On realising that the respondents are incorrectly described in the cause title, learned counsel for the petitioner sought for permission of the Court to withdraw the writ petition with liberty to his client to file a fresh writ petition with proper description of the respondents.
The writ petition is accordingly dismissed as withdrawn with liberty to the petitioner in terms of the prayer made.
As a sequel to the dismissal of the writ petition, W.P.M.P.No.42011 of 2014 shall stand disposed of as infructuous.
