Heard learned counsel for the petitioner and Sri Punit Kumar Gupta, learned counsel appearing for respondent no. 2.
Petitioner has approached this Court challenging the notice dated 10.04.2018 issued by the City Magistrate, Allahabad requiring the petitioner to show cause and hand over the possession of the Waqf property house no. 163/146, Sabji Mandi (Chowk) Allahabad to the newly appointed 'mutwalli' of Waqf property by the Shia Central Waqf Board, Lucknow.
It appears that the petitioner is the erstwhile 'mutwalli' and after the respondent no. 6 has been appointed as 'mutwalli' by the Waqf Board he is not handing over possession of the Waqf property for which the aforesaid notice has been issued.
In any view of the matter, it is only a show cause notice and it is open to the petitioner to appear before the concerned authority and submit his reply and the Court has no doubt that in case any such reply is submitted, the said authority shall proceed and decide the same in accordance with law.
Writ petition disposed of finally.
