An objection is taken by Sri N.K. Giri, appearing for the respondents, with regard to maintainability of the writ petition on the ground that petitioner has not approached the authority concerned before coming to this Court, and therefore, a writ of mandamus would not lie.
After some argument in the matter, learned counsel for the petitioner comes up with the prayer to withdraw the writ petition with liberty to approach the second respondent in respect of his grievance.
Liberty stands reserved to the petitioner to approach this Court, in case there is a failure on part of the concern authority to examine his grievance.
Writ petition is, accordingly, dismissed as withdrawn with liberty, as prayed.
