This application u/s 482 CrPC has been filed for directing Principal Judge, Family Court, Kanpur Nagar to decide Case No. 121 of 2018 (Smt. Swati Sharma vs. Ashutosh Sharma), u/s 125 Cr.P.C.
Counsel for the applicant submits that the application for maintenance has been filed on 7.2.2018, but although one year has elapsed and notices were also published under the order of Court, but no order for maintenance has been passed.
In the facts of the case, this application is disposed of with direction to Principal Judge, Family Court, Kanpur Nagar to decide Case No. 121 of 2018 (Smt. Swati Sharma vs. Ashutosh Sharma), u/s 125 Cr.P.C., pending before him, expeditiously, without granting any unnecessary adjournment to either of the parties, preferably within a period of four months from the date of production of a certified copy of this order before him. In case, it is not possible to dispose of the case finally, then he shall pass order of interim maintenance, either on the next date fixed in the case, or within two months thereafter.
