Heard learned counsel for the petitioner and learned Standing Counsel for respondents no.1 to 4.
The petitioner pursuant to advertisement namely Police Constables Recruitment- 2018 submitted application for being considered for appointment on the post of Constable. The petitioner appeared in written examination, physical efficiency test and medical test. The documents verification of petitioner has been done.
Learned counsel for the petitioner has submitted that there is truthful disclosure in respect of pendency of criminal case against the petitioner and in this regard, he as drawn attention of this Court towards notarized affidavit dated 09.03.2021, annexed as Annexure-3 to the writ petition wherein in para 2 it is stated that one criminal case is pending against the petitioner. However, the petitioner did not provide details of criminal case. Subsequently, by another affidavit dated 15.06.2021, the petitioner has provided details of Case Crime Number and Section under which case is registered.
The grievance of petitioner is that despite the fact that petitioner has cleared all stages of selection proceedings yet the appointment letter has not been issued to him by respondent no.3.
Learned counsel for the respondents submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction may be issued to respondent no.3 to consider the grievance of the petitioner.
Considering the facts and circumstances of the case and without going into the merits of the case and with the consent of the parties, the writ petition is disposed off with liberty to the petitioner to file a fresh representation before the respondent no.3-Superintendent of Police, District Deoria, raising all his grievances within a period of two weeks from today. In case any such representation is filed by the petitioner, the respondent no.3 shall consider and decide the same by reasoned and speaking order within a period of two months thereafter.
The writ petition is disposed off subject to the observations made above.
