JUDGMENT / ORDER

Court No. - 3
Case :- WRIT - A No. - 9077 of 2018 Petitioner :- Swapnil Shukla Respondent :- Union Of India And 2 Others Counsel for Petitioner :- Adarsh Singh,Indra Raj Singh Counsel for Respondent :- A.S.G.I.,Abhishek Mishra
Hon'ble Pankaj Mithal,J. Hon'ble Saral Srivastava,J.
Heard Sri Indra Raj Singh, learned counsel for the petitioner.
Sri Abhishek Mishra has accepted notice on behalf of respondents No. 2 and 3.
The petitioner, who is a Branch Manager in the Syndicate Bank, has been put under suspension by the impugned order dated 08.03.2018 on the allegations of financial irregularities and for not following the banking guidelines in the grant of loans.
The above order of suspension has been passed in contemplation of a departmental enquiry.
The submission of Sri Singh, learned counsel for the petitioner is that previously a notice was given to the petitioner and his explanation was sought for which he had submitted but no action thereof was taken and therefore, there is no justification for putting him under suspension at this stage.
The earlier notice has nothing to do with the present order of suspension which has been passed by the competent authority and in contemplation of a departmental enquiry.
We do not find any illegality in the said order.
Accordingly, the Writ Petition is dismissed with the observation that the respondents, if necessary, would institute the disciplinary proceedings against the petitioner and complete it as soon as possible in accordance with law.
Order Date :- 30.3.2018 piyush
