THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO DIRECT OR ORDER TO THE RESPONDENT NO.2 TO 5 NOT TO UTILIZE THE BUILDING/PREMISES OF THE PETITIONER FOR THE UPCOMING PARLIAMENTARY ELECTIONS/ASSEMBLY ELECTIONS AND ETC.
THIS PETITION COMING ON FOR PRELIMINARY HEARING, THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER Sri.Malla Reddy B.V., learned counsel for the petitioner.
Sri.Y.D.Harsha, learned AGA for the respondents.
Petition is admitted for hearing. With the consent of learned counsel for the parties, the same is heard finally.
2. In this petition, petitioner inter alia seeks for a writ of mandamus directing to the respondent Nos.2 to 5 not to utilize the premises of the petitioner for the upcoming Parliament Elections.
3. When the matter was taken up today, learned counsel for the petitioner submitted that with regard to its grievance, the petitioner has submitted a representation to the Deputy Commissioner and aforesaid Authority be directed to decide the representation by a speaking order within a fixed limit.
4. On the other hand, learned Additional Government Advocate for the respondents submits that the representation submitted by the petitioner shall be considered in accordance with law.
5. In view of the submissions made and in the facts of the case, petition is disposed of with a direction to the Deputy Commissioner to decide the representation submitted by the petitioner by a speaking order within three days from the date of receipt of certified copy of this order passed today.
The petitioner shall produce the copy of this order before the Deputy Commissioner.
