Heard learned counsel for the petitioner and learned A.G.A. for the State.
By way of the instant application, the petitioner has prayed for a direction to the Additional Judge, Negotiable Instruments Act Court, Muzaffarnagar, in Complaint Case No.3087/9 of 2015, under Section 138 Negotiable Instruments Act, 1881, Police Station Civil Lines, District Muzaffarnagar, expeditiously.
Contention raised before this Court is confined to the ambit that the proceeding of this case has been pending since 2015 and unnecessary adjournments have been given at asking of opposite party, which is causing great annoyance to the petitioner and judicial interest of the petitioner is adversely affected, virtually creating miscarriage of justice.
I have considered the submissions advanced by learned counsel for the petitioner and perused the record.
Obviously, the court below is under obligation to expedite the proceeding adhering to the provision of Section 309 Cr.P.C.
In this view of the matter, this petition is disposed of with the direction that the trial court will expedite and dispose the aforesaid case in accordance with law expeditiously from the date of production of a certified copy of this order before it after affording opportunity of hearing to the parties concerned.
