A preliminary objection has been raised by Sri Arun Kumar, counsel for respondents no.3 and 4 that the impugned recovery has been issued in pursuance of the order which is under challenge in Writ-C No.13926 of 2018. It is urged that since the cause of action is same, therefore, the petitioners have remedy of filing application in the pending writ petition.
After some argument, counsel for the petitioners prayed for withdrawal of the instant petition with liberty to seek stay in the pending writ petition.
The prayer made is allowed. The writ petition is disposed of as withdrawn with liberty in terms of the prayer made.
