Heard learned advocates for the parties. In view of the averments made in the application, the delay caused in filing the first appeal is required to be condoned. Accordingly, delay is condoned. Civil application stands allowed accordingly. First appeal may come up for hearing as to admission on 31st January 2012. Rule is made absolute accordingly.

Names of learned advocates for the respective respondents to be shown in first appeal. In the meantime, Mr. Dave shall supply copy of the appeal memo to the learned advocates appearing for the respondents.
