This appeal is filed against an order of the Commissioner for Workmen's Compensation/Deputy Commissioner of Labour, Coimbatore awarding a sum of Rs.4,18,460/- [Four Lakhs Eighteen Thousand Four Hundred and Sixty Only] as compensation for the death of one Ramachandran @ Ramakrishnan, who is the husband of the 1st appellant/Susiladevi and the father of the minor appellants 2 and 3.
2. By the said award, the Commissioner for Workmen's Compensation has directed the 2nd respondent viz., Velusamy to pay the entire compensation amount.
3. Pending this application, the 2nd respondent has come forward to pay a sum of Rs.3,00,000/- [Rupees Three Lakhs Only] and it was received by the first appellant. A Joint Memo of Compromise has been filed to that effect duly signed by the parties. The 1st appellant, as the guardian of the appellants 2 and 3 has signed the compromise memo. The learned counsel for the appellants has filed a certificate to the effect that the compromise is beneficial for the minors. An affidavit has also been filed by the guardian/1st appellant, stating that the compromise is beneficial to the minors.
4. In view of the same, the Joint Memo of Compromise is recorded and the appeal is disposed of in terms of the compromise memo. The sum of Rs.3,00,000/- has been paid over to the 1st appellant for herself and on behalf the minor children.
5. In view of the same, the full satisfaction of the award is recorded. The Memorandum of Compromise shall form part of the records. No costs. Consequently, C.M.P.No.15293/2017 is closed.
