Heard learned counsel for the petitioner and learned Standing Counsel for the State respondents.
In view of the order proposed to be passed, notices need not go to the third respondent.
With the consent of learned counsel for the parties, the writ petition is being decided without calling for counter affidavit.
The petitioner is before this Court for a direction to the second respondent, Naib Tehsildar, Tehsil Sadar, District Deoria to decide Mutation Case No.5831/2017 under Section 34 of U.P. Revenue Code, 2006 (Sushma vs. Ram Ganesh) within stipulated period.
Considering the facts and circumstances of the case and without entering into the merits of the issue, the writ petition is disposed of asking the second respondent to consider and decide the aforesaid case in accordance with law expeditiously and preferably within three months from the date of production of certified copy of this order but certainly after giving opportunity to all parties concerned. It is made clear that no unnecessarily adjournment shall be granted in the case and all endeavour should be made to decide the case expeditiously, subject to cooperation of parties as well as convenience/roster of the Court.
