Heard Sri Jai Prakash Prasad, learned counsel for the petitioners and Sri Udai Chandani, learned counsel for the contesting respondents.
In view of the order proposed to be passed, notices need not go to the private respondents.
The petitioners are before this Court for a direction to Additional District Judge, Moradabad, to decide the Misc. Civil Appeal No.45 of 2017 (Smt. Sudesh Kumari and others Vs. Smt. Shushma Katyal and another) within stipulated period.
It is argued by learned counsel for the petitioners that since the matter is pending consideration before the court below for a long time they are suffering irreparable loss.
Considering the facts and circumstances of the case, without interfering in the order passed by the trial court and without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the concerned court below to consider and decide the aforesaid appeal in accordance with law expeditiously but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties if there is no legal impediment.
The interim order granted by the High Court will continue till the decision taken on the appeal.
