Heard the counsel for the petitioner as well as learned Standing Counsel for the State.
The present writ petition has been filed by the petitioner praying for a writ of mandamus directing the Naib Tehsildar Saidabad, Tehsil-Handia, District-Varanasi, i.e., respondent No. 2 to decide Case No. 49/59/70/581, Computer Case No. T20140203042920 (Sushma Devi Vs. Krishna Murai) filed under Section 34 of the Uttar Pradesh Land Revenue Act, 1901.
Without expressing any opinion into the merits of the case, the Naib Tehsildar Saidabad, Tehsil-Handia, District- Varanasi, i.e., respondent No. 2 is directed to decide the aforesaid case within a period of three months from the date a certified copy of this order is produced before him after hearing the concerned parties in case there is no legal impediment in deciding the aforesaid case.
With the aforesaid direction, the writ petition is disposed of.
